BiS Lists Forcing Items even when De-selected as a raid option

I’ve deselected Ulduar 25, leaving just Ulduar “Normal” – even disabled Algalon but the generated BiS list under that snapshot continues to force “Constellus” as the weapon for Holy Paladin. This weapon simply is not available with the configuration options set

If the character from which you start has an item equipped already, it is always available. Start from a character with low-level or no gear equipped.

Is this true with PVP gear also. When i use the BIS, and select no PVP, it will still select some. I have not payed attention to whether or not i owned the piece that is selected.

Is there a secondary source? e.g. can some of the PvP gear be purchased with emblems as well?
